The N.C. Supreme Court upheld a decision Friday ordering a new trial for a Forsyth County man convicted in 2013 of raping a 6-year-old girl.
Thedford Roy Rorie Jr., 38, was convicted in July 2013 of first-degree rape, three counts of sex offense with a child and taking indecent liberties with a child. Judge A. Moses Massey of Forsyth Superior Court sentenced Rorie to 57 years and six months to 71 years in prison.
But in August, the N.C. Court of Appeals ordered a new trial for Rorie, saying that Massey was wrong to exclude evidence that Rorie could have used to challenge the girl’s credibility.
The state Supreme Court denied Friday a motion asking for a review of the appeals court’s decision. The N.C. Attorney General’s Office, on behalf of the Forsyth County prosecutors, filed the motion.
